It states the terms and conditions under which you may access and use the Website. By accessing and using the Website, you are indicating your acceptance to be bound by the terms and conditions of this Agreement. If you do not accept these terms and conditions, you must not access or use the Website. Sinneave may revise this Agreement at any time by updating this posting. Sinneave and the SINNEAVE logo are trade marks of The Sinneave Family Foundation. Other names, words, titles, phrases, logos, designs, graphics, icons and trade marks displayed on the Website may constitute registered or unregistered trade marks of Sinneave or third parties. The display of third-party trade marks on the Website should not be taken to imply any relationship or license between Sinneave and the owner of said trade mark or to imply that Sinneave endorses the wares, services or business of the owner of the said trade mark.

Password-Protected Access

There are parts of Sinneave managed websites may be accessed by username and password only. Access to and use of any password-protected areas is restricted only to users who have been authorized as such by Sinneave. Your password is for your own use and is not to be given to any other person or entity to use. You are responsible for maintaining the confidentiality of your password and you agree to notify Sinneave immediately if the confidentiality of your password has been compromised or breached. Any misuse of the password will result in immediate removal of your ability to access the Website.

Third-Party Content

Sinneave’s websites may include comment sections, question and answer widgets,forums widgets, and interactive areas (the “Features“). By using these features, you agree to not perform the following:

  • upload to, distribute or otherwise publish through the Forums any message, data, information, text or other material (“Content“) that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable;
  • upload or transmit any Content that would constitute or encourage a criminal offense, or violate the rights of any party, or that would otherwise create liability or violate any local, provincial, national, or international law;
  • upload or transmit any Content that may infringe on any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;

By posting any Content onto the forum widgets, comment sections, question and answers widgets, you represent and warrant that you have the lawful right to distribute and reproduce such Content. Sinneave will not be responsible for and assumes no liability for any Content posted or uploaded by you or any third party, or for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter in the above-mentioned Features.

Monitoring, Editing and Disclosure of Communications

Sinneave has the right, but not the obligation, to monitor any activity and Content associated with its Features (forum widgets, comment sections, question and answers widgets, and any other widgets), For greater certainty, Sinneave may: (i) investigate any suspected or reported violation of its policies or complaints; (ii) issuing warnings; (iii) suspend or terminate service; and/or (iv) remove, screen or edit any Content.

Sinneave maintains the right at all times to edit, disclose, refuse to post, request removal of, or remove any Content as may be necessary to comply with any law, regulation or government or agency request or if, in Sinneave’s sole discretion, such Content is objectionable or in violation of these Terms and Conditions. Sinneave may access and disclose any information it considers necessary or appropriate, including, without limitation, posted Content, user profile information (e.g., name, e-mail address), IP address and traffic information, and usage history to: (i) protect Sinneave’s systems and customers; (ii) ensure the integrity and operation of Sinneave’s business and systems; or (iii) cooperate with legitimate governmental requests, subpoenas or court orders, if required.

Sinneave‘s Rights to Materials Provided by Users

Any or all material and information provided by you to us through our Website may be included in a database owned by Sinneave and its subsidiaries and affiliates in which we have rights and interest, including, but not limited to, a compilation copyright. We maintain the right to use any information or materials you provide to us or that we obtain through your use of the sites to the fullest extent permitted by law.

You grant to Sinneave a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free license to use (including use for promotional and advertising purposes), copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit and otherwise use any Content, or other information or materials that you provide to us through the Website, including any ideas or original materials contained in such communications, in all media now known or hereafter developed (the “User Materials“), and you waive: (i) all material rights in the User Materials; (ii) all rights to any claim against Sinneave for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with the User Materials; and (iii) agree and understand that Sinneave is under no obligation to use any material or ideas contained in the User Materials in any way whatsoever. Sinneave’s failure to insist upon or enforce strict performance of any provision of these Terms of Use shall not be construed as a waiver of any provision or right.


The Internet constitutes the largest resource supporting freedom of information today for the user community in general and for users with disabilities in particular. This LMS meets compliance of the WCAG 2.1 (Web Content Accessibility Guidelines), exceeding Canada’s Standard on Web Accessibility of WCAG 2.0 Level AA criteria. Courses contained within may comply with WCAG 2.0 criteria or higher. The LMS developer invests in ongoing LMS accessibility improvements and updates to the accessibility functionality may continue to improve.

Despite our efforts to apply accessibility to browsing on every webpage, it may be discovered that some of webpages, courses, and widgets, have not yet received accessibility or are not suitable for any available accessibility solution.

We are continuing the effort to improve the website’s accessibility to the full extent possible, guided by our belief, and by our moral commitment, that the website should be usable by the entire population, including people with disabilities.

The foregoing limitation shall apply even if Sinneave knew of or ought to have known of the possibility of such damages.

Entire Agreement

Except for any agreement in respect of Content, this is the entire agreement between you and Sinneave relating to your access and use of the Website and the Content herein. If any term or provision of this Agreement is held by a court of competent jurisdiction to be invalid, it shall be severed, and the remaining provisions shall remain in full force without being invalidated in any way.
